These Terms & Conditions ("Terms") govern your use of Orbit and the orbitwork.sh website (the "Service"), operated by Datanest ("we", "us", "our") from Aotearoa New Zealand. By accessing or using the Service, you agree to these Terms. If you do not agree, do not use the Service.

Using the Service

You must be at least 18 years old, or the age of majority in your jurisdiction, to use the Service. You are responsible for keeping your account credentials secure and for all activity that occurs under your account.

Acceptable use

You agree not to:

  • Use the Service for any unlawful purpose or in breach of any applicable law;
  • Attempt to gain unauthorised access to the Service or its underlying systems;
  • Interfere with or disrupt the integrity or performance of the Service;
  • Reverse engineer, resell, or misuse the Service except as expressly permitted; or
  • Use the Service to store or transmit malicious code or infringing content.

Your content

You retain ownership of the content you create or store in the Service. You grant us a limited licence to host, process, and transmit that content solely to provide the Service to you. You are responsible for ensuring you have the right to use any content and credentials you supply.

Agents and automation

Orbit runs AI agents and automated tasks that you direct. You are responsible for the instructions you give and for reviewing the output. We are not liable for actions taken by agents acting on your instructions.

Availability

We aim to keep the Service available and reliable but do not guarantee uninterrupted access. We may modify, suspend, or discontinue any part of the Service at any time.

Intellectual property

The Service, including its software, design, and branding, is owned by Datanest and protected by intellectual property laws. These Terms do not grant you any rights to our trademarks or branding.

Disclaimer

The Service is provided "as is" and "as available" without warranties of any kind, whether express or implied, to the fullest extent permitted by law.

Limitation of liability

To the maximum extent permitted by law, Datanest will not be liable for any indirect, incidental, or consequential damages, or for any loss of data, profits, or business arising from your use of the Service.

Governing law

These Terms are governed by the laws of New Zealand, and any disputes will be subject to the exclusive jurisdiction of the New Zealand courts.

Changes to these Terms

We may update these Terms from time to time. When we do, we will revise the "last updated" date above. Continued use of the Service after changes take effect means you accept the updated Terms.
